Santé Sauvage is a website dedicated to the sale of dietary supplements represented by Genevieve LAWRENCE, who is the operator of this site.

The present General Terms and Conditions of Sale (hereafter the "GCS") are proposed by Santé Sauvage whose head office is located at 16 Chemin de la Colline, 81500 Lavaur and registered with the Trade Register of Castres under the number 511 374 423 R.C.S Castres and whose VAT number is FR90511374423.

In this case, the applicable conditions will be those applicable on the site at the date of the order.

ARTICLE 1 - PURPOSE

The present general conditions of sale express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation the entirety of the provisions set out in these general conditions of sale. The Seller undertakes for its part to respect its role as a reseller under these conditions.

ARTICLE 2 - CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED

The products and services offered are those which appear in the catalog of the site www.sante-sauvage.com of the company SANTE SAUVAGE, within the limit of available stocks. The company SANTE SAUVAGE reserves the right to modify the range of products at any time. Each product is presented on the Site in the form of a description of its main technical characteristics (capacity, advice for use, composition, etc.). The photographs are as accurate as possible but do not bind the Seller in any way. The sale of the products presented in the www.sante-sauvage.com site is intended for all buyers residing in countries that fully authorize the entry of these products into their territory. 

ARTICLE 3 - PRODUCT INFORMATION

3-a: Santé Sauvage presents on its website the products for sale with the necessary characteristics to comply with article L 111-1 of the Consumer Code, which provides the possibility for the potential consumer to know before the final order the essential characteristics of the products he wishes to buy.

3-b: The offers presented by Santé Sauvage are valid only within the limit of available stocks. Santé Sauvage reserves the right to modify the assortment of products according to the constraints imposed by its suppliers.

3-c: The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are not contractual. Consequently, Santé Sauvage cannot be held responsible in case of error or omission in one of these photographs, texts or graphics, information or characteristics of the products or in case of modification of the characteristics of the products by the suppliers.

3-d Santé Sauvage could not be held responsible for the inexecution of the concluded contract in case of out-of-stock condition or unavailability of the product, force majeure, disturbance or all-out or partial strike notably of the postal services and other means of transport and/or communications, flood, fire.

3-e: Hypertext links may refer to other sites than the "Santé Sauvage" site. Santé Sauvage disclaims all responsibility in the case where the contents of these sites would contravene the legal and regulatory provisions in force.

3-f: Santé Sauvage guarantees the Customer for hidden defects that may affect the delivered products, by a replacement of defective products, or damages making them unfit for use, or their reimbursement, without being considered by the Customer as responsible for the possible harmful consequences that these hidden defects could have caused.

ARTICLE 4 - PRICES

4. The price inclusive of tax of each product is indicated in the corresponding product sheet. The Seller reserves the right to modify its prices at any time, it being however understood that the price appearing in the catalog on the day of the order will be the only one applicable to the customer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased according to the total amount of the order. Delivery charges may be deducted, or offered free of charge at the Seller's discretion.  The article below entitled "Delivery - Applicable rates" lists the applicable rates for participation in shipping costs. The Seller reserves the right to carry out promotional operations over specified periods. It will be specified for each operation whether or not it can be cumulated with the applicable rates.

ARTICLE 5 - VALIDITY - DURATION

The present general conditions come into force on the date of the order. The present general conditions are concluded for the duration necessary for the supply of the goods and services subscribed to, until extinction of the guarantees.

ARTICLE 6 - ORDERS

The customer who wishes to purchase a product or service must obligatorily :

- fill in the online order form by selecting all the references of the products or services chosen ;

- validate the order after having checked it;

- select the delivery option from the list of options offered;

- make the payment which includes the price of the article(s) and contribution to delivery costs under the conditions provided;

- confirm the order and payment.

Confirmation of the order implies acceptance of the present terms and conditions of sale, the acknowledgement of having perfect knowledge of them and the renunciation to avail oneself of one's own terms and conditions of purchase or other conditions.

All the data provided and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.

The Seller will communicate by e-mail, the confirmation of the registered order.

After validation of the order, no modification of the order can be taken into account. The customer must place a new order to add additional items.

The products sold on the Santé Sauvage website are forbidden for resale following purchase by the customer. Any order exceeding six (6) items of the same product in the same order or within the same month will not be accepted by the seller. In other words, the Seller will not accept orders for more than six (6) items of the same item per month. 

The Seller can in no way be held responsible for the consequences of misuse of the products sold, nor for the consequences of use for a purpose other than that for which they are intended.

SANTE SAUVAGE reserves the right to refuse or cancel any order from a buyer with whom there is a dispute concerning the payment of a previous order.

ARTICLE 7 - TERMS OF PAYMENT

Before any order, the buyer can create an account on the site www.sante-sauvage.com. The buyer can also purchase as a visitor without creating an account. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile...), will have to identify himself using this information. 

The company SANTE SAUVAGE proposes to the buyer to order and pay for its products in several steps, with

- the Option of secure payment by credit card via the Prestashop Checkout which uses the credit card payment gateway with Paypal for those who do not have a Paypal account, and by Paypal for buyers who have a Paypal account, 

- LOption of payment by credit card via the payment service provider STRIPE - secure payment service by credit card. 

- The Paypal Option : It is not mandatory to have a personal Paypal account. 

If for any reason, one of these payment services is temporarily unavailable, the buyer may, if he wishes to continue his purchase, select the other available payment service. The Seller reserves the right to change the payment options at any time and the buyer will have the opportunity to view the payment options and make an informed decision as the option will be clearly indicated. 

- Secure payment by STRIPE: the buyer selects the products he wishes to order in the "shopping cart", modifies if necessary (quantities, references...), verifies the delivery address or enters a new one. Then, depending on the chosen shipment, the shipping costs are calculated and submitted to the buyer. Then, the buyer chooses the payment method "Payment by Credit Card". The next step is to check all the information, read and accept the present general terms of sale by ticking the corresponding box, then invites him to confirm his order by clicking on the "Confirm my order" button. Finally, the customer is redirected to the STRIPE secure interface in order to securely enter his personal credit card references. If the payment is accepted, the order is registered and the contract is definitively concluded. Payment by credit card is irrevocable. In case of fraudulent use of the card, the customer may demand the cancellation of the card payment, the sums paid will then be credited or refunded. The responsibility of the cardholder is not engaged if the disputed payment has been proven fraudulent. In order to obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the cardholder must contest the debit in writing with his or her bank within 70 days of the transaction, or 120 days if the contract binding him or her to the bank so provides. The amounts debited are reimbursed by the bank within a maximum period of one month after receipt of the written objection from the cardholder. The holder will not be charged for any costs incurred in returning the sums.

- Payment by PRESTASHOP Checkout: The buyer has the possibility to pay his order either by Paypal or by credit card and will follow the payment instructions.

The confirmation of an order implies acceptance of these terms and conditions of sale, the acknowledgement of having perfect knowledge of them and the renunciation to avail oneself of one's own terms and conditions of purchase. All the data provided and the recorded confirmation will be worth proof of the transaction. The buyer will have previously filled in his e-mail address and the company SANTE SAUVAGE will send him by e-mail the confirmation of the registration of his order.

ARTICLE 8 - PROOF OF TRANSACTION

The computerized records, kept in the computer systems of Indian Health, under reasonable conditions of security, will be considered as proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable support that can be produced as proof.

ARTICLE 9 - RESERVATION OF OWNERSHIP

The company SANTE SAUVAGE retains full and entire ownership of the products sold until full payment of the price, in principal, costs and taxes included.

ARTICLE 10 - RIGHT OF WITHDRAWAL

In application of the provisions of article L. 221-19 of the French Consumer Code, the Customer has a fourteen (14) days deadline as from the reception of the order to exercise his right to send back the goods to Santé Sauvage, without having to justify reasons nor to pay a penalty, and ask for a refund, provided that the products are returned in their original packing, complete, unopened, sealed and intact ready for resale. Damaged, soiled or incomplete products will not be refunded. The Products must be returned within fourteen (14) days following the notification to Santé Sauvage of the Customer's decision of withdrawal. This delay begins at the beginning of the first hour of the first day and ends at the end of the last hour of the last day of the delay. If this period expires on a Saturday, Sunday or holiday, it is extended until the first following working day.

Before returning the package, the buyer who wishes to return good must send an e-mail to the following address: info@sante-sauvage.com expressing his/her wish to return the goods. The buyer must imperatively accompany the package with the withdrawal form below or any other unambiguous statement expressing his or her decision to withdraw. The statement must included the information featured on the form. The product in its original packaging, suitable for resale as well as the withdrawal form must be sent to :

Santé Sauvage will reimburse the price of the order except for the delivery costs once the product is received by the Customer Service at SANTE SAUVAGE, 16 Chemin de la Colline 81500, LAVAUR, without having been opened or used and in the original packaging, unsealed, and in perfect condition. A photocopy of the purchase invoice must be attached. The Seller does not reimburse shipping costs. 

Products that are opened, damaged, soiled, partially used, or returned incomplete by the buyer will not be exchanged or refunded. The buyer is free to choose the postal method for returning the products, SANTE SAUVAGE not being responsible for the possible non-receipt of the package from the buyer. Return costs and risks will remain the responsibility of the customer. Products returned and deemed to be compliant will be reimbursed within fourteen (14) days at the latest by SANTE SAUVAGE by the same means of payment as that used for the purchase, to the delivery address indicated by the purchaser, as soon as the returned products are received.

In the event of an abusive return, SANTE SAUVAGE reserves the right to refuse any subsequent order.

ARTICLE 11 - SHIPPING AND DELIVERY 

Orders are shipped to the address indicated by the customer on their order, which can be different from the billing address. Shipping can only be within the agreed geographical areas configured on the site. Shipping times are given only as an indication. The company SANTE SAUVAGE will be able to provide the buyer with the tracking number of his or her package by e-mail. For each order, a fixed fee is requested for each order, which includes the cost of shipping, packaging and processing of the order.

Orders are processed from Monday to Saturday. An order made on Mondays before 12:00 can be shipped on the same day. An order made on Mondays afternoon will be shipped the following afternoon. The same applies for weekdays except until Friday 12:00. An order made on Friday before 12:00 will be shipped the same day. An order made on Friday afternoon will be shipped on the following Monday afternoon. 

Shipping times should take into account processing time of one day if it's a weekend, or a weekend, or a bank holiday and delivery times should be calculated as from the moment the parcel has been shipped, not as from the order. 

Deliveries are currently made by services provided by La Poste and by DPD from France. Delivery times within France are those given as an indication by La Poste: 48h for Colissimo (French parcel post). 48h for DPD. For deliveries outside of France, within the EU, the average delivery time is 5 days. Orders placed on a Sunday or a bank holiday will be shipped the next business day (and express orders shipped Monday to Friday). In case the occurrence of a bank holiday or a slowdown of the Internet network, or even a technical breakdown, would cause a delay in the delays initially planned by Santé Sauvage, the latter commits to do everything possible to limit this delay and to ship the order to the purchaser as soon as possible. 

COLISSIMO offers several delivery options which are : 

- home delivery with signature

- home delivery to a letter box without signature

- Delivery to a pick up point

In the event of absence during a Colissimo home delivery to the address indicated by the purchaser, a delivery notice is normally deposited in the letter box, or by text message, and indicates that the parcel will be represented the next day. In the event of a further absence during the second delivery, a notice will again be deposited in the letterbox - it is then possible to collect the parcel from a post office within 10 days of the deposit of this notice. If the purchaser does not pick up the parcel at the post office, the parcel will be returned to Santé Sauvage. Customer Service can then contact the buyer for a possible reshipment. 

Parcels delivered to a Colissimo pickup point are available at the pick up point for a period of 10 days after which, if still unclaimed, they will be returned to Santé Sauvage. The customer will have to pay a further shipping fee for a second delivery. In the event that the customer no longer wishes to pursue the order, he or she will inform the customer service of Santé Sauvage by email à info@sante-sauvage.com and a refund will be made to the clustomer for the price of the products but the delivery costs will not be refunded. 

Shipping times should take into account processing time of one day if it's a weekend, or a weekend, or a bank holiday and delivery times should be calculated as from the parcel has been shipped, not as from the order. 

DPD offers different delivery options. Santé Sauvage has chosen the following services with DPD

DPD PREDICT - a home delivery service by appointment

DPD delivery to the workplace

DPD Relai, delivery to a pickup point 

Delivery times within France are 48h as from moment of shipping. Processing time is not included in this shipping time. Shipping times should take into account processing time of one day and, if the order is made on a weekend, or a bank holiday, delivery times should be calculated as from the moment the parcel has been shipped, not as from the order. 

Each shipping is considered to be effective as soon as the products ordered are made available to the buyer, this can be verified by the delivery tracking service and follow-up system proposed on the Internet site of the Post Office in the case of a colissimo delivery or by DPD or another transport service. 

For countries outside the European Union, customs duties may apply. It is up to each customer to pay the applicable import duties of your country.

ARTICLE 12 - DELIVERY CHARGES

Santé Sauvage offers two choices of providers for deliveries. The Colissimo services of the Post Office for home delivery in letterboxes with tracking, a Colissimo service with delivery in a collection point, as well as the DPD service with home delivery (PREDICT), work (CLASSIC) and in delivery in a collection (DPD Relais).

The different delivery times for a Colissimo shipment are as follows:

- Parcel to Metropolitan France, Monaco and within the DOM-TOM: 48 hours (2 days)

- Overseas parcels: 5 to 7 days

- International parcels: 4 to 8 days depending on the country of destination.

COLISSIMO Home delivery within FRANCE

Delivery charges for parcels delivered to your home with the COLISSIMO service of the French Post Office in Metropolitan France (including Corsica), Monaco and Andorra Colissimo France: Postage by weight with proof of deposit, delivery in a letter box (without signature, or with counter-signature for parcels over 5 kg), tracking and commitment to delveiry within 2 working days as from the deposit of the parcel at the Post Office. The delivery times of the Post Office do not include and do not take into account the processing time required by Santé Sauvage to prepare the order before sending.

ARTICLE 13 - DAMAGED GOODS

The risks related to transport are the responsibility of the purchaser from the moment the articles leave the premises of the company SANTE SAUVAGE. In case of damage during transport, any protest must be made to the carrier within two days of delivery. Any anomaly concerning the delivery (damage, missing product compared to the delivery order, damaged parcel, broken products ...) must be imperatively notified in writing by registered letter to the carrier within two days of delivery. In the case of a shipment made by the Post Office, if the package arrives open or damaged (in particular with the presence of the yellow "La Poste" tape) it is essential that the customer has a "spoliation report" (damaged goods) drawn up by the local post office so that SANTE SAUVAGE can open an investigation and a compensation procedure. The Customer must simultaneously send a copy of this letter (along with the original of the "spoliation report", if applicable) by mail to : SANTE SAUVAGE 16 Chemin de la Colline, 81500 LAVAUR. Any claim received after the deadline will be refused. In the case of a shipment made by DPD or by any other carrier, the procedure is identical (i.e. a written report to the carrier within two days of delivery with a copy by email to Santé Sauvage).

ARTICLE 14: DELIVERY ERROR - NON-COMPLIANT PRODUCTS

14-a: The consumer will have to inform SANTE SAUVAGE the same day of the delivery or at the latest the first working day following the delivery, any complaint regarding error of delivery and/or non-conformity of the products in kind or in quality compared to the indications appearing on the purchase order/invoice . Any claim made after this deadline will be rejected without possibility of appeal.

14-b : The formulation of this complaint to Santé Sauvage can be made by e-mail addressed to "info@sante-sauvage.com". The e-mail will be processed as soon as possible from Monday to Friday, excluding public holidays.

14-c : Any complaint not carried out in the rules defined above and within the time limits could not be taken into account and will release Santé Sauvage of any responsibility towards the consumer.

14-d : Upon receipt of the complaint, Santé Sauvage will assign a return number for the product(s) concerned and will communicate it to the consumer. The return of a product can only take place after the attribution of this number according to the procedure presented above.

14-e : In case of a delivery error, or non - conformity of a product or apparent defect, any product to be exchanged or refunded must be returned within 8 working days following receipt of the agreement of return to Santé Sauvage in its entirety (accessories and notices included) and in its original packaging, sealed intact, in perfect condition, by a reliable delivery service, to the following address : Santé Sauvage, 16 Chemin de la Colline, 81500, France. The reshipment costs will be fully refunded by the Seller at the current rate on the basis of the French post office parcel service (Colissimo). To be accepted, any return must be notified in advance to the company Santé Sauvage, 16 Chemin de la Colline, 81500, France. If the above procedure is not complied with, no complaint for non-conformity or apparent defect of the delivered products will be accepted.

ARTICLE 15 - WARRANTY

All products supplied by the company SANTE SAUVAGE benefit from the legal guarantee provided by articles 1641 and in compliance with the French Civil Code.
