Santé Sauvage is an Internet site dedicated to the sale of food supplements represented by GENIALMM SARL, which operates this site.

These General Terms and Conditions of Sale (hereinafter the "GTCS") are offered by Santé Sauvage, the commercial brand of the company SARL GENIALMM, whose registered office is located at 49 Avenue Jacques Besse, 81500 Lavaur, FRANCE and which is registered in the Castres Trade Register under the number 90435616900022 R.C.S Castres and whose Intracommunity VAT number is FR53904356169. ARTICLE 1 - PURPOSE

These general terms and conditions of sale express all the obligations of the parties. In this sense, the consumer is deemed to accept unreservedly all the provisions of these general terms and conditions of sale. For its part, the Seller undertakes to respect its role as a retailer within the framework of the said conditions.

ARTICLE 2 - CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED

The products and services offered are those listed in the catalogue of the website www.sante-sauvage.com within the limits of available stocks. Santé Sauvage reserves the right to modify the range of products at any time. Each product is presented on the Site in the form of a description of its main characteristics (active ingredients, non-active ingredients, volume or weight, number of capsules, grams or liters, instructions for use, composition, etc.). The photographs are as accurate as possible but are not binding on the Seller. The sale of the products presented on the www.sante-sauvage.com site is intended for all buyers residing in countries that fully authorise the entry of these products into their territory. 

 

ARTICLE 3 - PRODUCT INFORMATION

3-a: Santé Sauvage presents on its website the products to be sold with the necessary characteristics to enable compliance with Article L 111-1 of the French Consumer Code, which provides for the possibility for the potential consumer to know the essential characteristics of the products he/she wishes to purchase before placing a final order.

3-b: The offers presented by Santé Sauvage are only valid while stocks last. Santé Sauvage reserves the right to modify the assortment of products according to the constraints imposed by its suppliers.

3-c: The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are not contractual. Consequently, Santé Sauvage cannot be held responsible in the event of an error or omission in one of these photographs, texts or graphics, information or characteristics of the products or in the event of modification of the characteristics of the products by the suppliers.

3-d: Santé Sauvage shall not be held responsible for the non-execution of the contract entered into in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike in particular of the postal services and other means of transport and/or communications, flood, fire.

3-e: Hypertext links may lead to sites other than the "Santé Sauvage" site. Santé Sauvage declines all responsibility in the event that the content of these sites contravenes the legal and regulatory provisions in force.

3-f: Santé Sauvage guarantees the Client in respect of latent defects which may affect the products delivered, in the context of replacement of defective products, or damage rendering them unfit for use, or reimbursement without the Client being able to be held responsible for any harmful consequences which these latent defects may have caused.

 

ARTICLE 4 - PRICES

The price (including VAT) of each product is indicated on the corresponding product sheet (except for Internet users residing outside of the European Community in which case prices are featured without VAT. The payment of VAT may be applied in entry into the country of delivery if that country is not an EU member state. In this case, each buyer has the responsibility for paying any VAT or customs duties that may be applied to their order). The Seller reserves the right to modify its prices at any time, it is understood, however, that the price appearing in the catalogue on the day of the order will be the only price applicable to the customer (unless there is an obvious technical failure or piracy that may incur changes to prices or content) in which case the Seller reserves the right to cancel any orders placed and refund the buyer for any payment advanced if that payment was not fraudulent. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the weight of the order. Delivery costs may be deducted or offered at the Seller's discretion. The article below entitled "Delivery - Applicable rates" sets out the options available for delivery. The Seller reserves the right to carry out promotional operations over specific periods. It will be specified for each operation whether or not it can be combined with the current rates.

 

ARTICLE 5 - ENTRY INTO FORCE - DURATION

These general terms and conditions come into force on the date of the order. These general terms and conditions are concluded for the duration necessary for the supply of the goods and services subscribed to, until the expiry of the guarantees.

ARTICLE 6 - ORDERS

Customers wishing to purchase a product or service must :

- fill in the basket with the desired products

- confirm their order after checking it;

- make the payment in accordance with the conditions laid down;

- confirm their order and payment.

Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgment that you are fully aware of them, and waiver of your right to invoke your own terms and conditions of purchase or any other terms and conditions.

All the data supplied and the recorded confirmation will be deemed proof of the transaction. Confirmation will constitute signature and acceptance of the operations carried out.

The Seller will send confirmation of the recorded order by e-mail.

Once the order has been validated, no changes can be made to the order. The customer must place a new order if additional items are required.

Products sold on the Santé Sauvage website are prohibited for resale following purchase by the client. Any order exceeding six (6) boxes or 6 bottles for the same product in the same order or in the same month will not be accepted by the Seller. In other words, the Seller will not accept orders for more than 6 boxes of the same item per month.

The Seller may in no case be held liable for the consequences of improper use of the products sold, nor for the consequences of their use for a purpose other than that for which they are intended.

SANTE SAUVAGE reserves the right to refuse or cancel any order from a purchaser with whom there is a dispute relating to the payment of a previous order.

 

ARTICLE 7 - PAYMENT METHODS

Before placing an order, the purchaser may create an account on the www.sante-sauvage.com website. The buyer may also purchase as a visitor without creating an account. The account creation section can be accessed directly from the side menu bar. Each time they visit the site, buyers wishing to place an order or consult their account (order status, profile, etc.) must identify themselves using this information.

On sante-sauvage.com, you can order and pay for your products by selecting one of the following payment options:

The Paypal option with payment in one instalment, or payment in 4 instalments: To make a payment in 4 instalments without charge managed by Paypal, you need to open a Paypal account and reside in France. 3. The option of payment by cheque - only available for French customers with a bank account domiciled in France. In this case, select the "payment by cheque" option before confirming your order.  Write the total amount including postage and packing to the order of GENIALMM SARL.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement that you are fully aware of them and waiver of your right to invoke your own terms and conditions of purchase. All of the data supplied and the recorded confirmation will constitute proof of the transaction. The purchaser will have previously entered his/her e-mail address and SANTE SAUVAGE will send him/her confirmation of the registration of the order by e-mail.

ARTICLE 8 - PROOF OF TRANSACTION

The computerized registers, kept in the computer systems of Santé Sauvage, under reasonable conditions of security, shall be considered as proof of communications, orders and payments between the parties. Order forms and invoices are archived on a reliable and durable medium which may be produced as proof.

ARTICLE 9 - RETENTION OF TITLE

SANTE SAUVAGE retains full and complete ownership of the products sold until full payment has been received, in principal, costs and taxes included.

ARTICLE 10 - RIGHT OF WITHDRAWAL

In application of the provisions of article L. 221-19 of the French Consumer Code, the Client has a period of fourteen (14) days from receipt of the order to exercise his/her right of retraction from Santé Sauvage, without having to give any reason or pay any penalty, for the purpose of reimbursement, provided that the Products are returned in their original packaging, complete (i.e.; accessories, instructions) and in perfect condition, enabling them to be marketed again. Damaged, soiled or incomplete Products will not be accepted. Products must be returned within fourteen (14) days following notification to Santé Sauvage of the Client's decision to withdraw. This period begins at the beginning of the first hour of the first day and ends at the end of the last hour of the last day of the period. If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

Before returning any parcel, the buyer who wishes to withdraw must send an e-mail to the following address: info@sante-sauvage.com expressing his/her wish to withdraw. The purchaser must enclose the following withdrawal form or any other unambiguous statement expressing his/her wish to withdraw with the parcel: The product in its original packaging, suitable for re-marketing, together with the withdrawal form, must be sent to :

Santé Sauvage will reimburse the price of the order except for delivery costs once the product has been received by the Claims Department, SANTE SAUVAGE, unopened and unused and in the original packaging in perfect condition. A photocopy of the purchase invoice must be enclosed. The Seller does not reimburse shipping costs for the return of the product(s).

Products opened, damaged, soiled, partially used, untied or returned incomplete by the purchaser shall not be exchanged or reimbursed. The purchaser is free to choose the method of return of the products, SANTE SAUVAGE not being responsible for the possible non-receipt of the purchaser's parcel. Return costs and risks shall be borne by the purchaser. Products returned and deemed to be in conformity shall be reimbursed within fourteen (14) days at the latest by SANTE SAUVAGE by the same means of payment as that used for the purchase, to the delivery address indicated by the purchaser, upon receipt of the returned products.

In the event of improper returns, SANTE SAUVAGE reserves the right to refuse any subsequent order.

ARTICLE 11 – LIVRAISON 

ARTICLE 11 - DELIVERY 

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical zones. Delivery times are given as an indication only; the status indicated online by the Post Office or by the carrier is authoritative. If by querying the tracking on the website of the carrier or the Post Office, the status indicates that the package has been delivered, but that the customer has not received the package, it is the responsibility of the customer to make a claim with the Post Office or carrier. Santé Sauvage cannot be held responsible for any loss or theft after dispatch. No compensation other than that provided in the terms and conditions of the Post Office or carrier chosen by the customer, can be required. Santé Sauvage will provide the buyer with the tracking number and any related information about their parcel by e-mail. 

For deliveries made by La Poste in France, delivery times are those given as an indication by La Poste: in France, allow 48 hours after shipping. For other countries see below for country specifics.  

Orders placed on a Sunday or public holiday will be dispatched the next working day (and express orders dispatched Monday to Friday). In the event that the occurrence of a public holiday or a slowdown in the internet network, or even a technical breakdown, causes a delay in the delivery times initially planned by Santé Sauvage, the latter undertakes to do everything in its power to limit this delay and to ensure that the purchaser is delivered as soon as possible. 

For home deliveries in France requiring a signature.: in the event of absence during delivery to the address indicated by the buyer, a delivery notice shall normally be left in the letterbox, indicating that the parcel will be represented the following day. If the customer is absent again during the second delivery, a notice will again be left in the letterbox - it is then possible to collect the parcel from a post office within 10 days of this notice being left. If the purchaser does not collect the parcel from the post office, the parcel will be returned to Santé Sauvage. We will then refund the cost of the order minus the shipping costs already paid.  

Each order is considered to have been fulfilled once the products ordered have been shipped and scanned by the Colissimo post office tracking system. This can be verified by the delivery control and tracking system offered on the La Poste website. https://www.laposte.fr/outils/suivre-vos-envois

Important: In the event of a dispute regarding the delivery of a parcel mentioned as having been delivered by the Post Office or returned to our company (dispatch confirmation e-mail with the parcel number), the customer should contact the latter directly for any claim. We decline all responsibility in this respect. The Post Office's website is the authoritative source.

For countries outside the European Union, customs charges may apply. It is up to each customer to pay the applicable import duties for your country.

DELIVERY AND COUNTRY SPECIFICS

- FRANCE - BELGIUM - LUXEMBOURG

For orders over €80, delivery is free to the collection point chosen by the customer in France, Belgium and Luxembourg, except during promotional periods. For orders under €80, the applicable delivery charges will be invoiced. Santé Sauvage reserves the right to deactivate free delivery during promotional periods.

SWITZERLAND AND IRELAND

For orders under €200, the applicable delivery charges will be invoiced. For orders over €200, postage is offered by our company.  Delivery by Colissimo within 4 to 5 days. Santé Sauvage reserves the right to deactivate free delivery for the duration of special offers.

SPAIN, PORTUGAL, NETHERLANDS, GERMANY, AUSTRIA, ITALY

Delivery costs are offered for orders over €250. Orders under €250 will be invoiced by weight for delivery costs. Delivery by Colissimo within 48/96 hours

UNITED KINGDOM

For orders to the UK, delivery is free for orders over €300. For orders under €300, delivery charges apply according to La Poste Colissimo rates. Customs charges apply to orders over £139. The responsibility for and payment of all additional costs such as VAT, import duties and customs clearance costs rests with the consumer.

Shipping policy

Santé Sauvage uses the services of La Poste France (Colissimo) for its deliveries in France and in the geographical zones proposed on this site.

For the general and specific conditions of this service provider, please refer to articles 11 and 12 of the General Terms and Conditions of Sale.

Orders placed on a Friday afternoon, Saturday, Sunday or public holiday will be dispatched on the next working day.

For special deliveries, at the customer's request, we can use DHL Express, or DHL Worldwide, please contact us at info@sante-sauvage.com.

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical areas. Delivery times are given as an indication only.

Packages are generally dispatched within 1 or 2 working days of receipt of payment. This means that if you place your order on a Friday, it will be processed on the following Monday or Tuesday at the latest. You can choose your preferred shipping method before payment. 

Shipping fees vary according to the total weight of the shipment. We advise you to group your items in one order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them. Particular care is taken to protect fragile items. The boxes are generously sized and your items are well protected.

 

Customs duties for countries outside the EU

For countries outside the European Union, customs duties may apply. It is the responsibility of each customer to pay the import duties applicable in their country.

Returned parcels sent to an incorrect address 

Returned parcels that the postal carrier was unable to deliver due to a wrong address, or because the client moved house, correspond to parcels returned by the service provider responsible for delivery under the mention: "Does not live at the address indicated". Upon receipt and acceptance of the returned parcel by SANTE SAUVAGE, a refund of the total amount of the order, with postage costs incurred on the initial shipping and the return shipping deducted, be made via the original means of payment for the order within forty-eight (48) hours following receipt of the parcel by SANTE SAUVAGE. The Customer may then place the order again, ensuring that the delivery address provided is correct.

Parcels unclaimed from pick up points

Returns on the grounds of "unclaimed" correspond to parcels that have not been claimed by Customers at the post office or at the retailer chosen by the Customer at the time of ordering within a period set by the service provider from the date of the delivery notice. Upon receipt and acceptance of the returned package by SANTE SAUVAGE's services, a refund of the total amount of the order, with postage costs incurred on the initial shipping and the return shipping deducted, shall be made via the initial means of payment for the order within forty-eight (48) hours of receipt of the package by SANTE SAUVAGE. The Customer may then place the order again.

 

ARTICLE 12 - DELIVERY - PRODUCT AVAILABILITY COSTS

Santé Sauvage offers the services of Colissimo de la Poste for home delivery with signature, letterbox delivery without signature, and delivery to a collection point (France, Belgium, Luxembourg). For other countries, we offer Colissimo de la Poste with home delivery against signature. 

The delivery times for Colissimo are as follows:

- Parcels to Metropolitan France, Monaco and the French Overseas Departments and Territories: 48 hours (2 days)

- Parcels to French overseas departments and territories: 5 to 7 days

- Parcels to International destinations: 4 to 8 days depending on the country of destination

 

Below is a list of postal charges in France for the three delivery options:

Delivery charges for parcels with the COLISSIMO service of the French Post Office to Metropolitan France (including Corsica), Monaco and Andorra Colissimo France: Postage by weight with proof of deposit, tracking and commitment to delivery within 2 working days from the date of deposit of the parcel at the Post Office. The delivery times of the Post Office do not include and do not take into account the time required by Santé Sauvage to process the order and prepare the parcel before dispatch.

ARTICLE 13 - LOST OR DAMAGED GOODS

The risks associated with transport are the responsibility of the buyer from the moment the items have been taken charge of by La Poste (Colissimo). In the event of damage during transport, any protest must be made to the carrier/La Poste within two days following delivery by the customer. Any anomaly concerning delivery (damage, product missing from the delivery note, damaged package, broken products, etc.) must be reported by email to the carrier within two days of delivery. In the case of a shipment made by La Poste, if the package arrives open or damaged (in particular by the presence of the yellow “La Poste” ribbon) it is essential that the customer has a “damaged goods” report drawn up by the local post office so that SANTE SAUVAGE can open an investigation and compensation procedure. The customer must simultaneously send a copy of this letter (with the original of the "damaged goods report", if applicable) by email to: GENIALMM SARL, BP80001, 81502 Lavaur Cedex. Any claim received after the deadline will be refused.

The status reported online by the Post Office or by the carrier is authentic. If by querying the tracking on the carrier's or Post's website, the status indicates that the package has been delivered, but that the customer has not received the package, it is the customer's responsibility to make a claim for parcel at the post office or carrier. The company GENIALMM SARL cannot be held responsible for any loss or theft after collection by La Poste (Colissimo) or by the carrier. No compensation other than that provided for in the general conditions of the Post Office or of the carrier chosen by the customer may be required.

ARTICLE 14: DELIVERY ERROR – NON-CONFORMING PRODUCTS

14-a: The consumer must make to SANTE SAUVAGE on the same day of delivery or at the latest the first working day following delivery, any claim of delivery error and/or non-conformity of the products in kind or in quality in relation to the indications appearing on the order form. Any complaint made after this deadline will be rejected without possibility of appeal.

14-b: The formulation of this complaint with Santé Sauvage can be made by email addressed to “info@sante-sauvage.com”. The email will be processed as quickly as possible from Monday to Friday, excluding public holidays.

14-c: Any complaint not made in accordance with the rules defined above and within the allotted time limits cannot be taken into account and will release Santé Sauvage from any liability towards the consumer.

14-d: upon receipt of the complaint, Santé Sauvage will assign a return number for the product(s) concerned and will communicate it to the consumer. The return of a product can only take place after this agreement number has been assigned according to the procedure presented above.

14-e: In the event of a delivery error, or non-conformity of a product or apparent defect, any product to be exchanged or refunded must be returned within 8 working days following receipt of the return agreement to Santé Sauvage in its entirety (accessories and instructions included) and in its original packaging in perfect condition, by Colissimo with tracking, to the following address: Santé Sauvage/GENIALMM SARL, BP80001, 81502 Lavaur Cedex, France. The reshipping costs will be reimbursed in full by the Seller at the rate in force for a tracked Colissimo service.
